…Killer husband with sad story jailed for 8 years
THE Prosecution yesterday presented at the High Court a pathetic story about contractor James Mc Pherson, who returned to Guyana suddenly and entered his home in time to find his wife Omecia Fiona, having sex in bed with a strange man. According to State Prosecutor Ms. James-Lake, the husband returned home unexpectedly one afternoon and, on entering his home, he was attracted to a ‘groaning’ sound emanating from inside a bedroom.
The bedroom door was pushed in but not locked. McPherson then decided to push the door open, following which he was confronted with the shocking sight of his wife having sex with a man he did not know.
Mc Pherson remained speechless as his wife’s sex-partner, who was naked, hurriedly put on his clothing and walked past the stunned husband who was still standing, stupified.
The wife then went to the bathroom, where she proceeded to have a bath before returning to the husband, begging him for forgiveness, and asking him to assist her to dry her skin with a towel she was holding.
The accused, who had pleaded not guilty to murder and offered a plea of guilty to manslaughter, which was accepted by the DPP, said: “At this stage, I did not know what happened, but I realized that I began to squeeze her throat. She screamed. I let her go and then I began squeezing her again. When I let her go, she fell unconscious.”
Later, a neighbour found the dead woman under the bed with a shirt over her head and her hands tied behind her back.
Following police investigations, the accused did not waste time but give a written statement in which he admitted to the crime and claimed that he was sorry for what had happened.
Yesterday, represented by Attorney-at-law Peter Hugh, he pleaded not guilty to murder but guilty to the lesser count of manslaughter which the prosecutors, Ms. Lake and Miss. Zamilla Ali, accepted.
In a dramatic and stirring appeal, Mr. Hugh stated that the accused is a humble contractor, who previously had an unblemished record.
Hugh said the accused found himself to be ‘no master of his mind’ by the particular circumstances, which amounted to severe provocation. He asked the judge to be lenient with his client.
Justice Winston Patterson took into consideration the fact that the accused did not waste anybody’s time and that he had shown remorse, plus the circumstances in which he had found himself that day.
When questioned by the judge, the accused said he was always faithful to his wife and that she had always been faithful to him. He is from Betsy Ground, East Canje, Berbice and is a Building Contractor by profession.
When asked what sentence he expected to flow from his wrong doing, the accused said, “something between 11 and 12 years”.
The judge surprised him by deducting 4 years and sentencing him to 8 years for an offence which carries a life imprisonment.
The accused, Mc Pherson, is a father of six children ( 3 twins) with his deceased wife, Omecia.
