Judge defers ruling on move to quash indictment
JUSTICE Brassington Reynolds is expected to rule, Tuesday, on preliminary submissions, by Defence Counsel Mursalene Bacchus, to quash the indictment against Quacey Cort. The accused, who is indicted at the Berbice Assizes for maliciously inflicting grievous bodily harm on Rajkumar Ganiadoo, pleaded not guilty.
Bacchus advanced his legal arguments, in the absence of the jury, before State Prosecutor Dionne Mc Cammon made her opening address but the judge deferred his ruling.
The leading Defence Counsel, who is associated with Mr. Rabindranauth Singh, argued that the committal is flawed because the magistrate who did it failed to comply with the mandatory provision of Sections 65 and 71 of the Criminal Law Procedure Act.
