In libel case involving the President…

Full Court chides unready lawyers for appellants
THE Full Court, hearing an appeal by Freddy Kisson and others against an injunctive order by the Chief Justice relating to a libel case involving the President, yesterday chided the lawyers for the appellants for wasting the court’s time.
Attorneys-at-Law Mr. Neil Parsram and Mr. Christopher Ram, for the defendants /appellants requested an adjournment on the grounds that they were not ready with their legal authorities.
The court, constituted by Justices Mr.  William Ramlal and Mr. Winston Patterson, criticised the lawyers for not being ready.
Mr. Anil Nandlall for the Applicant/Plaintiff, Mr. Bharrat Jagdeo, objected to the application on the ground that he was ready to go ahead. He however decided to accept cost for the day in the sum of $10,000. The court ordered the appellants to pay the sum of $10, 000 and adjourned the matter to June 15.
The President of the Court, Mr. Ramlal, pointed out to the appellants that if the costs were not paid by that time, they will not be heard.
The applicant/Plaintiff is Mr. Bharrat Jagdeo, while the Respondents/Defendants/Appellants are Frederick  Kissoon,  Adam Harris and  National Media and Publishing Company Limited.

Upon hearing Attorney-at-law for the plaintiff, and reading the affidavit, the Chief Justice had directed that the Respondents/Defendants be restrained and an interim injunction is thereby granted restraining the Respondents/Defendants from publishing the said or any similar words to that effect concerning the applicant/plaintiff as contained in an article published in the Kaieteur News of  July 28, 2010 under the Caption “King Kong sent his goons to disrupt the conference”, until the hearing and determination of a summons in this cause.
Subsequently the Respondents/Defendants appealed the granting of the injunction and contended that they would plead justification, privilege and fair comment as defences to the alleged libel.
Mr. Nandlall, for the plaintiff, is requesting that the appeal be dismissed with an appropriate order in respect of costs.
