Clive Mc Donald 24, of Lot185 Mongripper Bartica, was placed on $350,000 bail by Acting Chief Magistrate Priya Sewnarine-Beharry after being slapped with three charges ranging from unlicensed driving to causing death by dangerous driving.
Mc Donald pleaded not guilty to the two summary charges which stated that on December 7, at Second Avenue Bartica, he drove an ATV motor cycle without being the holder of a driver’s licence, he drove the said vehicle without it being legally registered.
In addition, Mc Donald pleaded not guilty to the charge of causing death by dangerous driving after the Administration of Justice Act (AJA) was applied. It is alleged that between December 7 and 8, 2010, at Second Avenue, Bartica, he drove an ATV motor cycle in a manner dangerous to the public, causing the death of Mariam Bennett.
He was represented by Attorney-at-Law Mr. Peter Hugh who told the court that on the day in question, his client was riding the motor cycle on Second Avenue Bartica when the now dead girl ran from behind a minibus and into the path of his client. He said Bennett was injured and later died.
With reference to the unregistered vehicle, Hugh disclosed that his client was not aware that the ATV motor cycle had to be registered. He said that his client had never been convicted of any criminal matter and neither does he have any pending matters in any court, hence he made an application for bail in a reasonable sum.
Mc Donald was placed on $25,000 bail each for being an unlicensed driver and for having an unregistered vehicle. He was also put on $300,000 bail for the causing death by dangerous driving charge.
The matters were transferred to Bartica court for January 5.
