Decision for firearm licence revocation quashed

ACTING Chief Justice, Mr Ian Chang, S.C., has granted a ‘nisi order’ seeking to quash a decision of the Divisional Commander of ‘D’ Division, to revoke the firearm licence of applicant Ramdyal Boodhan.
Boodhan, in his application for writs of certiorari, is saying that the Divisional Commander’s letter, dated the 19th August, 2010, revoking his firearm licence, No. G-86614, dated the 8th March, 2010, should be quashed on the ground that the decision is arbitrary, capricious, unreasonable, influenced by extraneous and irrelevant considerations, whimsical, unlawful, null, void and of no effect.

The applicant said that he was ordered to and did hand over his firearm to the Guyana Police Force as a result of an incident between himself (Applicant) and members of the Linden Town Council.

After hearing arguments from Attorney-at-Law Anil Nandlall for the applicant in the ex-parte matter, the Chief Justice ordered that a writ of certiorari be and is hereby granted and directed to the Divisional Commander  of ‘D’ Division (Leonora), quashing a decision of the said Commander contained in a letter dated the 19th August, 2010, revoking the applicant’s firearm licence, on the ground that the said decision is arbitrary, capricious, unreasonable, influenced  by extraneous and irrelevant considerations, whimsical, unlawful, null, void and of no effect.

It was further ordered that a writ of mandamus be and is hereby granted compelling the Divisional Commander to return to the applicant, one Maverick Single Barrel, 12 Gauge Shotgun, No. MV70044J, held under firearm licence No. G-86614, dated the 8th March, 2010.
The hearing was adjourned to December 15th.
