West Bank Demerara murder trial continuing

JUSTICE Winston Patterson was up to late yesterday hearing arguments   intended to support or reject the Prosecution’s submission that an alleged eye witness, who migrated to Suriname after testifying at the P.I., that his deposition be tendered in evidence. After an alleged oral confession which the  prosecution  sought to introduce in evidence was thrown out by the judge during a voir dire, the prosecutors, Miss Latchmie Rahamat and Ms. Judith Gildharie-Mursalin, made an application to the judge under Section 95, that the deposition of an eye witness who testified at the P.I. but who has since migrated, be tendered in evidence.
The evidence by the prosecution is that the injuries on Farzan Khan which caused death was inflicted with a broken bottle or a knife, an exhibit of the court.
But defence lawyer Mr. Vic Puran scored a point two days ago, when, under cross-examination, the doctor  who performed the post mortem disclosed that the injury was not inflicted by the bottle nor the  knife, the exhibit in court.
The hearing is continuing.
