Commissioner granted power to detain suspects until Oct. 9
MURDER suspects Bibi Shareema Gopaul, called Narie, and Jarvis Small, called Barry Small can now be kept in police custody until Saturday. Acting Chief Justice Mr. Ian Chang, S.C., granted an extension yesterday following an application by the Commissioner of Police which noted that 72 hours, the time allotted to keep suspects without a charge, had expired and the investigation was still continuing.
In his Ex Parte application by way of affidavit for an extension of time, Hugh Jessamy, Detective Assistant Superintendent of the Guyana Police Force, had made the application on behalf of the Commissioner.
According to him, the deceased Neesa Lalita Gopaul, had on the 16th of August, 2010, reported to the police that she was given rum to drink by Jarvis Small, called Barry Small, after which she was not conscious of what occurred, but was later told by Small that he had sexual intercourse with her at Splashmin’s.
She had also reported that on the 13th of August, 2010, she was given a substance to smoke which she smoked, because she said Small threatened to kill her mother if she did not smoke it. She was then taken to a hotel at Parika but she did not know what occurred there.
While investigations were being conducted, Bibi Shareema Gopaul ,and the deceased Neesa Lalita Gopaul, retracted these stories.
The deceased went missing between the 23rd and 24th of September, 2010.
The report of her being missing was made on the 25th of September, 2010 by Bibi Shareema Gopaul.
The headless body was found in a suitcase in the Madewini Creek in the vicinity of Emerald Tower Resort on Saturday, 2nd October, 2010, at about 14:00hrs.
Dumbbells similar to those found in a gym owned by Small were found tied to the suitcase in which the body was found.
Samples of what appeared to be blood and hair were taken from the residence of the said Bibi Shareema Gopaul and taken to the Police Forensic Department for testing.
In his ruling dated yesterday, the Chief Justice said:-
Upon reading the Ex-Parte Application by way of Affidavit for extension of time by Hugh Jessamy on behalf of the Commissioner of Police ,sworn to and filed on the 6th day of October, 2010, and upon hearing Ms. Rahamat, Attorney-at-law, for the applicant, It is hereby ordered that the Commissioner of Police be at liberty to keep in custody the bodies of Bibi Shareena Gopaul called Narie and Jarvis Small called Barry Small for the purpose of carrying out further investigation for the offence of murder of Neesa Lalita Gopaul until Saturday the 9th day of October, 2010, at 10 am.”
