Contractor Ramjohn wants more money from Clive Lloyd

– Says cricketer owes him $9.5M for variation works
FORMER Guyana/West Indies Cricket Captain Clive Lloyd, who has denied the claim through his Attorney, Ronald Austin, was in Court on Thursday to testify before Justice Rishi Persaud, but the matter was postponed to September 2, to facilitate Ramjohn’s Counsel, Mr. Bernard De Santos, S.C. who is out of the jurisdiction, to be present.
Building contractor Kailie Ramjohn is claiming from the defendant the sum of $9, 566, 798 being an amount due, owing and payable by the Defendant to the Plaintiff for variation of construction works of a 2-flat apartment building at Lot 150 Crown Street, Queenstown, Georgetown.
Ramjohn, represented by a team of lawyers, headed by Mr. Bernard De Santos, is saying that on February 26, 2007, the Plaintiff entered into an agreement with the Defendant to construct a residential two flat apartment building situate at Lot 150 Crown Street, Queenstown  for the sum of $35,000,000.00.
The Plaintiff entered unto the premises located at Lot 150 Crown Street, Queenstown and commenced construction work at the urging of the Power of Attorney Mr. Ronald Austin.
The Plaintiff further stated that as the construction of the 2 flat residence progressed the Power of Attorney, never expressed any dissatisfaction on the quality and  progress of work.
As the construction progressed the Power of Attorney ordered additional work to be done as well as upgrades.
After handing over the building, the Defendant’s Power of Attorney attitude changed and he became hostile and subsequently stopped taking telephone calls from the Plaintiff when he tried to inquire about his outstanding payments.
That the total cost to complete the project was the sum of $45,000,000.00 and the plaintiff has received the sum of $36, 900,000. And that there is a balance currently outstanding in the sum of $9, 566,798.00, the Plaintiff said in his statement of claim.
In his affidavit of defence, Mr. Austin said that he had no authority under the Limited Power of Attorney No. 7922 of 2006, to order any upgrade or variation to the contract, without the express consent of the defendant.
That the contract price for the complete works to be performed by the Plaintiff as set out in the contract of February 26, 2006,  is the sum of $35, 000, 000 (the contract price) and not $45, 000,000 as alleged in paragraph 18 of the Statement of Claim.
The affidavit of defence is saying that the Plaintiff’s claim is speculative, frivolous and an abuse of the process of the Court and should be dismissed with costs.
Representing the defendant Clive Lloyd  are Mr. Rex H. Mc Kay, S.C., Mr.  Fitz L. Peters, Mr. Neil Boston, Mrs. Abiola Wong-Inniss, Mrs. Bettina Glasford and Mr. Maxwell Mc Kay.
The hearing continues on September 2, 2010.
