Ruling will be delivered on June 3
THE pink suitcase High Court hearing now engaging the Full Court of Appeal observed yesterday that a letter to the press by the DPP stating that the Court did not have jurisdiction to hear the matter was ill-founded.
The Appeal hearing in the pink suitcase High Court hearing before Justices William Ramlal and Roxanne George continued yesterday when counsel Mr. Nigel Hughes, for the applicant, drew the Court’s attention to a newspaper report in which the writer, the Director of Public Prosecutions, expressed the view that the Court did not have jurisdiction to hear the matter.
Among other things, the DPP had intimated in her letter that the affidavit attached to the application had no evidence of bias or mala fide (bad faith) on the part of the DPP, and as a result, her advice to the police on the charges which were instituted by the police is not reviewable by any court, hence there is no legal merit in the application.
Commenting on the DPP’s letter in the newspapers, Justice Roxanne George said, “ It is indeed unfortunate that the holder of such a constitutional office who is legally trained should breach the profession by writing about a matter where she is a litigant and where the matter is currently engaging the attention of the court.

The Court will deliver its ruling on Thursday, June 3, 2010.
