JUSTICE Rishi Persaud has dismissed a $101,280, 423 claim, by Guyana Oil Company Limited (GUYOIL), from Meadow Bank businessman Feizal Mohamed Amin.
The judge, finding no merit in it, was also not satisfied with the manner in which the accounts were being prepared and kept by the plaintiff.
Justice Persaud held, too, that there were inconsistencies in the evidence resulting from cross-examination and no satisfactory testimony that any of the products were delivered to or were received by the defendant.
GUYOIL had claimed the money as being the balance for petroleum products sold and delivered to Amin, at his request, between September 7, 2005 and September 28, 2005.
But Amin denied being indebted to that amount or any other sum alleged and maintained that he had paid for all fuel and other merchandise received.
In his affidavit in defence, he declared that he did not carry on any business under the name of Amin Lumber Enterprise and was not registered to trade and nor did he trade under that name.
The defendant also contended that the payments made by him to GUYOIL were not taken into consideration and that his account was mixed up with others and or that there was a deliberate attempt to defraud him.
Justice Persaud also awarded $50,000 costs to Amin.
