Star witness Adams had ‘impaired’ memory at P.I.
STAR witness for the prosecution, Errol Adams, who told the judge and jury that the accused, Squince Mc Lennon, called ‘Killer’, and Trian Sumner, called ‘Tatie’, had beaten himself and Odingo Bryan (now dead), admitted that he had an impaired memory at the P.I. and could not remember whether he told these things to the magistrate.
In answer to defence counsel Mr. Basil Williams, under cross-examination, witness denied giving additional evidence to the jury in relation to the alleged acts of the accused at Buxton.
Witness also said that he could not remember whether five years ago he told the magistrate the same things he was now telling the jury, since at that time he was suffering from blows to the head which caused his memory to be impaired.
At first, the witness, who was called a pro by defence counsel, was contending that he did tell the magistrate what he was now telling the jury, but after counsel proved that the matters were not in the depositions, and such was confirmed by Presiding Judge, Justice Roxanne George, the witness declared that he was ill at the time and might have forgotten to tell the magistrate.
According to witness, he denied a suggestion that he might have told the story to the magistrate and the magistrate had omitted to record it.
Counsel had suggested to the accused that the reason why certain things were being told the jury by him as happened five years ago, when at that time no mention of those things was made to the court, was because the witness and his friend (now dead) had their own agenda for entering Buxton that day, and he was attempting to justify his presence in the warring district.
Witness denied the suggestion
Among the things that the witness had told the judge and jury were that following the incident, he had looked at the Kaieteur News paper and had seen a picture of Sumner in the hospital.
According to him, he visited the hospital where he saw the accused Sumner on a bed. He began looking at Sumner, who, he said, raised his head and asked, “Why are you looking at me?
Witness added, “I replied, is not you who attempted to murder me and murdered my partner. The Doctor should have given you an injection to kill you”.
The accused is indicted for the murder of Odingo Bryan committed on the 9th of January, 2004, when it is alleged that Bryan had visited Buxton with his friend Adams, to meet relatives who had returned to Buxton from New York.
Mrs. Judith Gildharie-Mursalin, in association with Miss Shavani Balcharan, is prosecuting.
The hearing continues on Monday.
