IN keeping with a Notice of Motion, Justice Roxanne George on Thursday granted businessman Barry Dataram’s request for leave to intervene in the matter of an application by Assistant Commissioner Seelall Persaud for Writs of Certiorari and Mandamus. As a result of an earlier application from Assistant Commissioner Persaud, Judge Roxanne George had granted a Nisi Order of Certiorari directing the Chief Magistrate to quash a decision in which she had refused to issue an arrest warrant for the arrest of Barry Dataram.
The application by Dataram yesterday sought leave from the Court for him to intervene in the proceedings as an added respondent under Order 14 Rule 14 and Order 40 Rule 6 of the Rules of the Supreme Court and or Articles 144 and 153 of the Constitution and or under the inherent jurisdiction of the Court.
It was also requested by the applicant that the Court order direct the applicant Seelall Persaud to amend the rubric in the present proceedings to reflect the order which this court makes.
Upon hearing Attorneys-at-Law for the applicant the judge ordered and directed the applicant Seelall Persaud to serve on Barry Dataram sealed and certified copies of the Notice of Motion herein and the Affidavit in support thereof.
It is further ordered that leave be granted to Barry Dataram as an interested party to file and serve on the applicant Seelall Persaud and the Hon. Attorney General an answer to the affidavit in support of the Notice of Motion filed herein, within two days of service of the said documents. (George Barclay)
