Murder accused Dunsford Dodson, whose fundamental right to a fair trial within a reasonable time was allegedly breached by the DPP by not readily providing a preliminary Inquiry for expediting the matter, has been granted bail in the sum of $500, 000 by Justice Roxanne George.
The Order was the result of a Constitutional Motion issued by Attorney-at-law Nigel Hughes in relation to his client Dodson seeking redress in the matter of Articles 40 and 144, 153 and 199 of the Constitution of the Republic of Guyana.
After hearing lawyers for the applicant and the respondent the judge said, “It is ordered that the Plaintiff / Applicant be admitted to bail in the sum of $500,000 subject to the plaintiff /applicant reporting to the Police Station as stated in the Order.
“It is further ordered that the plaintiff /Applicant lodge his passport with the Registrar of the Supreme Court and it is further ordered that the Plaintiff / Applicant be awarded the sum of $150, 000 as damages, and a $50, 000 for the aggravation of another year awaiting the completion of the Preliminary Inquiry, the prosecution of which is to commence within 10 days hereof, and is to complete the presentation of the evidence of the witnesses within 60 days thereafter, so that if the applicant is again committed and indicted, the prosecution is to expedite the presentation of his indictment for the trial on or before December 31, 2010.
