JUSTICE James Bovell-Drakes will on Tuesday rule whether or not the prosecution has made out a case for the accused Security Guard David Chesney to answer.
State Prosecutor Miss Prithima Kissoon closed the case for the prosecution yesterday morning following the testimony of the last witness, Pathologist Dr. Nehaul Singh, who had performed the post mortem on the body of the deceased O’Neil Adams.
Chesney had been accused of unlawfully killing Adams who had snatched money from a cambio dealer in Water Street and had rushed into a KFC branch in a bid to escape when he was cornered and shot.
The prosecution had set out to prove that the accused had cornered and shot the deceased after he was subdued, handcuffed and unarmed.
Forensic Patholigist Dr. Nehaul Singh, who testified yesterday, stated that he had performed the post mortem on the deceased and had found three gun shot wounds and had recovered two bullets.
Adams, the doctor said, died from perforation of the heart and lung due to gun shot injuries.
In answer to questions under cross-examination, the doctor said there was no evidence of the use of handcuffs on the deceased.
At the close of the Prosecution’s case, Defence counsel Mr. Vidyanand Persaud with Miss Prabha Persaud, sought permission from the judge to make certain no-case submissions in the absence of the jury.
Later, Prosecutor Miss Prithima Kissoon suitably replied to the submissions.
The judge will rule on Tuesday morning at 10 ‘o’ clock.
