Order granted over bridge building application discharged

$500M project…
THE nisi mandamus order granted businessman Maurice Rajkumar recently, after he alleged that he had been prevented from constructing a bridge to a housing project at Montrose, East Coast Demerara, was discharged yesterday, by Acting Chief Justice Ian Chang.

Attorney-at-law Mr. Anil Nandlall had secured the grant on the ground that Ministry of Works officials had been using delaying tactics to deal with the application to construct the overpass.

But Principal Legal Adviser to the Attorney General, Mr. Nareshwar

Harnanan contended that the reliefs prayed for by the applicant are entirely premature as there has been no refusal of permission or refusal to act in considering the request.

Harnanan submitted that the directives sought, which were seeking to compel the statutory authority, are entirely misconceived and Justice Chang, agreeing, also awarded costs to the respondents.

Rajkumar had said he built some houses for diplomats at the location and intended to enlarge the gated compound in a $500M project. (George Barclay)
