THE story of minibus conductor Leon Doris, called ‘Blackboy’, who allegedly raped a schoolgirl aged 15/16 years old, was related by State Prosecutor Ms Dianne Kauleser to Justice Franklyn Holder and a mixed jury at the Demerara Assizes yesterday, in her opening address. The accused has pleaded not guilty to committing the offence, and is being represented by Attorney-at-Law Mr. Peter Hugh.
Prosecuting for the State are Miss Dianne Kauleser and Miss Retina Singh.
Prosecutor Kauleser also pointed out that the difference between the offences of rape and carnal knowledge is that, with the latter offence, it does not matter whether the victim had consented to have sexual intercourse, since, by virtue of her age, she is not capable of consenting to sexual intercourse.
Narrating the facts of the case, Prosecutor Kauleser said it was on Friday, November 13, 2009 that the schoolgirl was at the minibus park with friends when the accused accosted her.
She used to travel in his bus and was acquainted with him, so when he asked her to go with him to collect a receipt from his sister in Kitty, she decided to go with him.
They went to a locked house in Kitty, and the accused called somebody. A man came and opened the door, and the accused went inside with the man.
Evidence will be led to show that, within a short while, the accused came outside and grabbed the girl by the wrist, pulling her into the house and into a bedroom.
The accused pushed the girl down on the bed and began kissing her. She tried to push him off, but he continued. She screamed and pleaded for him to stop, but he did not.
Instead, he pulled off her pants, tights and underwear, and forced his penis into her vagina.
The accused engaged in sexual intercourse with the schoolgirl. She did not willingly engage in this act, and she could not even legally consent to sexual intercourse, the prosecutor explained.
The prosecutor added, “This is a case where a young schoolgirl exercised poor judgement. She trusted someone and found herself in a situation no girl wants to be in.
“The victim left the house, went home and took a bath. She called her mother who was at work, and told her something. As a result her mother met her at the Brickdam Police Station, where she reported the matter that very day.
“The accused was arrested and taken to the police station, where the girl confirmed that he was the offender. The victim was medically examined, and a medical certificate was issued.
“The accused was subsequently charged.”
The prosecutor told the jury that, “in establishing the first element, which is that the accused had sexual intercourse with the victim, the State must prove to you, members of the jury, that the accused penetrated the vagina of the victim with his penis.”
The trial continues today.
