Prosecutor requests re-opening of Hinckson case

Special Prosecutor Sanjeev Datadin in the ongoing case against ex-Army officer Oliver Hinckson, accused of advocating a terrorist act, yesterday applied to the court to re-open the case.

But whether the application will be granted and the Prosecution allowed to present its final witnesses will be known on June 29, a new date set by Acting Chief Magistrate Melissa Robertson who is conducting the Preliminary Inquiry.

She had on the last court date, June 11, set yesterday to rule on a no-case submission made by lead defence attorney Nigel Hughes, following a failed appearance Datadin had promised through his clerk, despite the court awaiting his arrival for some three hours.

Hughes had further asked the court to discharge Hinckson.

Yesterday’s hearing was quite a stormy one, as tempers flared between Datadin and Hughes, as the latter objected to Datadin’s request to have the Court re-open the case.

The Defence became even more incensed when the Special Prosecutor, in response to a query by the Chief Magistrate as to his whereabouts on June 11, said he was in High Court to file an action against her.

Hinckson was slapped with two charges, uttering a seditious statement and advocating a terrorist act, as a result of a statement he made during a function at City Hall on February 11, last year.

The first charge has been adjourned sine die.
