Magistrate rules evidence inconsistent, dismisses drug case

INCONSISTENT police evidence resulted in the dismissal of a drug case Monday by Magistrate Sherdell Isaacs-Marcus.

The narcotic possession charge, against Onika Griffith was dismissed because of the inconsistency of the main witness, Cadet Officer Alonzo.
The police had alleged that on July 8, 2013, about 08:00 hrs, ranks were on patrol in Stanleytown, Berbice, where they observed the defendant walking briskly ahead, whilst constantly looking backwards.
As a result, she was stopped and a search of her clenched fist revealed a transparent plastic bag containing a creamish substance which, when weighed, amounted to three and a half grammes.
In her defence, the unrepresented Griffith said she was cycling along Republic Road, also in Stanleytown, when she was made to stop and, when she disembarked, she felt something at the side of one foot.
She said the police asked if the parcel belonged to her and, after responding negatively, she was instructed to pick it up and hand it over, following which she was taken to the station and the suspected cocaine weighed, the woman explained.
