In domestic violence cases… Man imprisoned, woman bonded pending outcome

CHIEF Magistrate Priya Sewnarine-Beharry, declaring no tolerance for domestic violence, Thursday, sentenced Gensham Bullen, 24, of Lot 60 Lime Street, Werk-en-Rust, Georgetown, to seven days imprisonment for behaving in a threatening manner towards the mother of his child.

Particulars of the offence, to which the prisoner had pleaded not guilty, said it was committed on Monday, September 2, when he threatened Akesha Pyneandy in Lime Street.
Police Corporal Bharat Mangru, prosecuting, told the Court that the defendant was under the influence of alcohol when he held a knife to the woman’s throat, telling her she cannot find a better man than him.
She reported the incident because she became fearful for her life, the prosecutor said.
But the woman, admitting that Beharry is the father of her child, said she does not wish to proceed with the case against him.
Brief hearing
She also responded in the negative when the Chief Magistrate asked her if she wanted to apply for a protection order against Bullen but after she maintained that what she reported to the police was the truth, the magistrate conducted a brief hearing and found the defendant guilty as charged.
The Chief Magistrate, before pronouncing sentence, said she took some mitigating factors into consideration, including Bullen’s age, the seven years relationship with the mother of his child and his age.
She said the aggravating factor is that the defendant had consumed alcohol as a voluntary act which resulted in his placing the knife on the virtual complainant’s neck and that the latter had to wait until he left the house to lock the door as she was in fear.
Theirs was one of two cases involving domestic violence.
In the other, Indra Persaud, of Lot 47 Fifth Street, Albouystown, also in the city, pleaded not guilty to using abusive and threatening language to her sister, Gaitree Persaud, on Monday, September 2, at the same address.
Prosecutor Mangru said the virtual complainant was sitting on her front step with her family when the defendant arrived drunk and started to abuse her and threaten to burn her house.
However, the prosecutor did not object to bail and the defendant was released on her own recognisance but bonded to keep the peace pending the determination of the case, for which she has to make her next appearance on September 18.
