In his first attempt he approached the High Court by way of prerogative writs seeking to quash the said charge and to prohibit the state from proceeding with the said charge.
His application was rejected after the hearing of arguments made on behalf of the Attorney General before the Hon. Chief Justice Ian Chang.
Sanassie then appealed the decision of the High Court to the Court of Appeal and in the interim made an application to a single Judge in Chambers of the Court of Appeal to have the charges stayed again until the appeal is heard and determined.
Once again after hearing arguments from, Deputy Solicitor General Prithima Kissoon appearing for the Attorney General and Mr. Roysdale Forde, Attorney-at-Law for Sanassie, the Court of Appeal rejected Sanassie’s application.
The result is that the criminal charges against Sanassie are to proceed.
