AS a result of an advertisement by U-Mobile (Cellular) Inc. to implement overseas rates cuts, the Guyana Telephone and Telegraph Company Limited (GT&T) has taken an ex-parte action against that company, resulting in Justice Dawn Gregory granting an injunction restraining the company from carrying out the planned operations. The advertising programme followed last Friday’s High Court ruling by Justice Rishi Persaud who upheld the contention that GT&T’s Telecommunications service monopoly is unlawful and in breach of the Civil Law of Guyana.
Apart from restraining the U-Mobile (Cellular) directors, managers , employees, servants, and/or agents from advertising, commencing running or operating an international call service other than through interconnection with the plaintiff or without having first obtained a licence to so do, as required by the provisions of the Telecommunications Act 1990, it is further ordered that the plaintiff be at liberty to serve on the defendant a summons returnable for the 3rd day of August, 2012, in chambers.
The judge also ordered that there must be a sealed and certified copy of this writ of summons filed herein and a sealed and certified copy of this Order and a sealed copy of the Ex parte application by way of affidavit sworn to herein on the 26th day July,2012.
The matter has been adjourned to the 3rd day of August, 2012, at 10:30 a.m. in chambers.
