JUSTICE Rishi Persaud has granted mandatory and interim injunctions restraining the Guyana Geology & Mines Commission (GGMC), Shoreham Resources Inc. and Odinga Lumumba, from entering certain mining claims in the Cuyuni River.
The defendants had seized the properties but the judge has prevented their entry until the hearing and determination of a related summons which is returnable on April 13.
Justice Persaud acted Thursday on an ex parte application to restrain the respondents/defendants from interfering with the rights to mines which the applicant, Justin Timmerman, had occupied.
The judge directed his order to the respondents/defendants by themselves, their servants and or agents, decreeing that they must not enter upon, remain, occupy or in any manner, whatsoever or howsoever interfere with the applicant/plaintiff’s quiet and peaceful occupation of Evette, Evette 1, Evette 2, Evette 3 and Evette 4, on the bank of Mariwa Creek, Cuyuni River.
The GGMC must also, forthwith, deliver to Timmerman, 28 pieces of equipment which were unlawfully confiscated by its servants and or agents on or about March 17, 2011 and are still being detained.
In his supporting affidavit, Timmerman said he has been occupying the claims over the last 20 years without any objections from anyone, including the GGMC and with its knowledge, expended approximately $40M on the construction of roads, bridges and buildings.
He was represented by Mr. Anil Nandlall, Mr. Euclin Gomes and Mr. Manoj Narayan, attorneys-at-law.
