I bought a plot of land from a gentleman in Zeelugt, East Bank Essequibo for $225,000 on January 14, 1994 and I spent a lot of money to build a house and a business place (concrete structure). I also took loans from IPED for the purpose of a tyre shop and chicken farm.
However, just after I started out the business, I took ill and had a surgery on my right knee where I had 10 stitches. As a result of this I was unable to work to repay the loan so I ran bankrupt with IPED.
My wife and I decided to sell the property to repay IPED.
I was offered by a man to purchase the property at $6 million. I consulted my big brother in Georgetown. He told me not to worry with the man that he will give me $5 million to build a big business and I would get a job as well as my wife and I would get access to still live in the house.
I had discussion with my wife and we decided to go for my brother’s offer. On the 14 December 2001 I entered into a contract with my brother’s son who also lives in Georgetown, but he only paid me $400,000 to tie up the deal. The contract stated that the balance of $4,600,000 will be paid on the passing of a bank loan from New Building Society.
On October 15, 2001 my brother paid me $263,000 plus $20,000 on behalf of his son,.
On April, 2002 my brother paid me another part payment of $1 million by cheque #022366-7305 on the property – Lot 299 Zeelugt, East Bank Essequibo.
In the meantime I was paying to the Ministry of Housing for the house lot, I had applied to the Minister for the transfer of the house lot to my nephew.
The Minister made me paid $262,000 as a penalty fee which I did. The Minister, Mr. Shaik Baksh issued the Transport to my nephew. My brother made some other small payments leaving the balance of $2,400,000 which is the amount I, Deonauth Bharat owed IPED.
Since my nephew got the Transport for the property he stopped paying me any money on the outstanding balance.
IPED summoned me to court and when I told my big brother, Paul, he said to me that his lawyer said that I should not worry because IPED cannot do anything because the property is already transferred to Junior.
My brother called me later and gave me and my nephew an open cheque to go and pay IPED $ 2 million when the balance was $2, 400,000. The Manager of IPED said that she cannot receive the $2 million and write off the $400,000. Since then my brother never offered me any money.
IPED summoned me again to court and I told my brother and he told me not to show myself to IPED and also do not let the people around know that I am around.
I did not go to court and the Judge Mr. Winston Patterson tried the case in my absence and placed an order that whatever assets I own they will be seized. The date of the trial was December, 12, 2005.
Why should I suffer for somebody else mistake? I am calling on somebody to help me please. I am also calling on my brother Jaipaul Bharat and his son Surujaul Bharat known as Junior to please pay me my money that they owe me which is a total of $4,400,000. I want to pay government some taxes and also to repay IPED what I owe them.
My importer and distributor and son of Lot 299 Zeelugt, East Bank Essequibo please pay me $2,400,000 cash and the balance of $2 million for my mini bus BGG 6978 which IPED seized.
I am also calling on New Building Society to please find out from persons first if the property they are giving loans to whether it is indebted or not before processing and approving loans.
Why should I suffer because of somebody else’s mistake?
