Non-attendance of virtual complainant frees robbery defendants

THE three men, previously implicated in the recent Gizmos and Gadgets robbery, but charged with simple larceny and damage to property, were freed yesterday.

Acting Chief Magistrate Melissa Robertson dismissed the cases for want of prosecution.

Marvin Williams, 34, of Lot 47 Diamond, East Bank Demerara, Dexter Conway, 32, of Lot 207 Barr Street, Kitty and Raulston Kennedy, 30, of Lot 1958 North Ruimveldt, two Georgetown addresses, first appeared in Court last November 23, before Magistrate Priya Beharry.

They were remanded to prison after pleading not guilty to the allegations that, on November 20, they stole a quantity of food items and a rice bucket valued a total of $150,000 and damaged one minibus door lock worth $25,000, all property of Darshanie Dhanraj.

But yesterday, Defence Counsel Adrian Thompson pressed for the dismissal submitting that the virtual complainant does not seem interested as she was absent from Court for the second time.

Police Sergeant Krishnadat Ramana, prosecuting, acknowledged that Dhanraj had failed to attend but requested a final adjournment.

Other Prosecutor, Inspector Stephen Telford said the booty was found in hire car HB 3971, which the defendants were using.

He said the Court should take into consideration that the virtual complainant identified the trio as the robbers and they have other matters pending in another Court.

“That’s why you have to get the witnesses present in Court,” the magistrate told Telford, before discharging the trio.
