Defence challenge to statement triggers smaller trial
DEFENCE Counsel Raymond Ali advanced preliminary submissions which triggered a voir dire (trial within a trial) before Justice Brassington Reynolds, after the lawyer challenged the admissibility of a statement attributed to accused Shawn Tyndall called Arthur or Asha. Tyndall is indicted for the murder of Camille Medina De Jonge, a weeder attached to the East Berbice Sugar Estates, who was discovered dead in her bed with a gaping wound to the neck, at McGowan Street, Manchester Village, Corentyne, Berbice but the lawyer argued that the statement was not given freely and voluntarily.
The accused has denied the allegation that, between Sunday 24 and Monday 25 September, 2008, he unlawfully killed De Jonge.
The lifeless body of the mother of two was discovered by her children who were attempting to awaken her.
The cause of death is recorded as shock and haemorrhage resulting from a wound to neck.
State Counsel Rhondell Weaver is prosecuting in the case that is continuing at the Berbice Assizes.
