Crime Chief reminds public that consistently loud music is a crime
CRIME Chief Seelall Persaud reminded the public yesterday that it is a crime to play loud music consistently and, under the criminal law, police can investigate and take action.
He offered the reminder in light of the pile-up of complaints countrywide, with the exception of hinterland areas.
The Assistant Commissioner said there are cases in which police have received numerous complaints and, once they observe it is consistent, they ask offenders to turn down the volume. That is for the prevention mode but for disturbance reports statements are taken and the necessary prosecution follows.
He pointed out that persons have been taken to court for noise nuisance but not in interior locations.
Meanwhile, Taajnauth Jadunauth, a member of the National Commission on Law and Order said, yesterday, that the noise nuisance is a major problem in his village, Enmore, East Coast Demerara.
He said he is greatly affected by loud music which is played from early morning until late in the night.
Jadunauth said he is in the process of writing a letter to the Neighbourhood Democratic Council (NDC) to seek its intervention, as he is quite frustrated and hopes something can be done to address the issue.
Chairman of the Private Sector Commission (PSC), Ramesh Dookhoo said he did not want to comment.
Only last week, the Ministry of Home Affairs said it continues to receive numerous complaints from senior citizens, the sick, working parents, students and several other law- abiding people, who are being affected by loud, repetitive and continuous noise emanating from a range of places in the different police divisions.
The ministry said, in a release, that, after verifying the validity and justification of the complaints, the relevant Divisional Commanders of the Guyana Police Force (GPF) have been provided with the details and directed to take appropriate action.
These commanders have been directed to take appropriate action to ensure that: Subsection (1) of Section 174A of the Summary Jurisdiction (Offence) Act as amended by Act No. 1 of 1989 states the following:
“No person shall, in any road, street, public place or land or in building or premises, by operating or causing or suffering to be operated any stereo set, juke box, radio, wireless loudspeaker, gramophone, amplifier, automatic piano or similar instrument of music, or by any other means whatsoever, make or cause or suffer to be made any noise which shall be so loud and so continuous or repetitive as to cause a nuisance to occupants of any premises in the neighbourhood.”
The ministry said the Police Force will be adopting ‘a no nonsense approach’ and the full force of the law to deal with offenders.
A summary conviction for such an offence carries a fine of not less than $7,500 nor more than $15,000, imprisonment for six months and a second or any subsequent conviction a fine of not less than $20,000 and imprisonment for 12 months.
