TWO men who were on trial for unlawfully killing Mohamed Abdool Shameer in 2016 were on Wednesday acquitted by High Court Judge Sandra Kurtzious at the Suddie High Court, Essequibo Coast.
Lennox Baharally and Rondell Edwards were charged for killing Shameer, on April 26, 2016 at Jacklow, Pomeroon.
After state prosecutor Lisa Cave closed her case on Wednesday, the defendants’ attorney, Jerome Khan, made a no-case submission for the charge to be dismissed, submitting that the prosecution had failed to make out a prima facie case against his clients.
Khan submitted to the court that the prosecution had failed to show that Baharally committed any act that was unlawful leading up to the accident. Additionally, Khan submitted that the state had also failed to establish that his clients acted in a manner that was dangerous to themselves and the public at large, or that the two accused behaved in a negligent or reckless manner.
Justice Kurtzious ruled in favour of the no-case submission and directed the jury to return a verdict of not guilty.
The duo was initially charged with murder, but the charge was reduced to manslaughter after the Preliminary Inquiry at the Charity Magistrate’s Court by Magistrate Sunil Scarce.
According to reports Shameer was the uncle of Baharally.
According to reports, Shameer was Baharally’s uncle. It was alleged that Shameer was in his canoe when Baharally’s boat collided with him. Baharally and Edwards allegedly killed Shameer and buried his body in a shallow grave along the bank of the Pomeroon River.
