Linden resident remanded on drug charges

TROY Nicholas, 45, of Victory Valley, Wismar Linden was remanded to prison on Monday by Chief Magistrate Ann McLennan, on three drug-related charges.

He was charged with smoking cannabis, possession of cannabis and possession of cocaine for the purpose of trafficking. Particulars of the charges alleged that on May 4, 2017 at Linden, Nicholas had 4.3 grams of cannabis in his possession; it is further alleged that on the same date and location, Nicholas smoked cannabis. It is also alleged that he had 22.4 grams of cocaine in his possession for the purpose of trafficking.

He pleaded not guilty to the three charges; his lawyer Daren Wade, in an application for bail, explained that the drugs were not found in his client’s possession. The lawyer alleged that the drugs were planted by the police.

However, Police Prosecutor Alwyn Moore debunked the lawyer’s allegations, noting that the accused was arrested with the drugs in his possession during a police raid. The Prosecutor said that the accused was observed smoking cannabis by the police when he was apprehended.

The ranks searched the accused and reportedly found 4.3 grams of cannabis in his possession. The police took Nicholas back to this home and deepened their search. While in the bedroom, police reportedly found whitish substance suspected to be cocaine, on his bed. A field test was done on the substance and it was tested positive for cocaine.

The prosecutor objected to the Nicholas being allowed his pre-trial liberty, citing that no special reasons were raised by the lawyer for bail.

The Magistrate ruled in the prosecution’s favour and remanded Nicholas until May 17, 2017; the matter was transferred to the Linden Magistrate’s court.
