AFTER the close of the Prosecution’s case yesterday in the ‘Picture Boy’ double murder, accused Cyon Collier called ‘Picture Boy’ led an alibi defence.
Collier said he was at Linden at the time he was alleged to have shot two brothers with an AK-47 weapon.
In an unsworn statement from the dock, the man who it is alleged shot and killed Roy Walcott called ‘Sugar’ and Carl Andrews called ‘Alo’ said: “I am innocent of this crime. The police kicked me several times on my scrotum and forced me to confess to a crime of which I know nothing about. As a result of the kicks, I suffer from hydrocele.”
The current trial is a retrial. Like on the first trial, the accused summoned Surgical Expert, Dr. Dalgleish Joseph to testify about the effects of hydrocele and its causes.
But Dr. Joseph, when asked by Prosecutrix Mrs. Judith Gildharie-Mursalin whether he did not consider examining the accused to determine whether the kicking on his scrotum could have brought on hydrocele, the doctor explained:
“At the first trial the accused lawyer Mr. Lyndon Amsterdam, applied to the then judge for permission for me to examine the accused but the examination was refused. Therefore, I could not examine him.
Doctor Joseph, who was deemed an expert by the judge because of his experience, was questioned about the post mortem reports in the case and was critical about the report as it related to the deceased Andrews.
On the resumption today defence Counsel Mr. Amsterdam and State Counsel Mrs. Mursalin will deliver their addresses to the jury.
Justice Navindra Singh, the presiding judge will sum up the evidence to the jury on Monday following which he would hand over the case to the mixed jury for their consideration and verdict.
