ACTING Chief Justice, Mr. Ian Chang, S.C., yesterday morning discharged the order he had made in the matter of Chief Elections Officer, Gocool Boodhoo on July 2nd, preventing the Chairman and Commissioners of the Guyana Elections Commission (GECOM) from making a decision not to renew his contract.
The granting of the Nisi Order resulted from the applicant Gocool Boodhoo applying to the court for a writ or Order Certiorari, Order Mandamus and Order Prohibition. The Chairman and the Commissioners of the Guyana Elections Commission were respondents.
In an Originating Notice of Motion, filed by Attorneys-at-Law, Mr. Murselene Bacchus and Mr Sase Gunraj, the court was asked for an Order or Rule Nisi Certiorari directed to the Chairman and Commissioners of the Guyana Elections Commission to show cause why they have not renewed the contract of the Applicant which came to an end on the 31st of April, 2013, thereby quashing the decision not to automatically renew the contract of Boodhoo on the grounds that the decision taken by the Chairman and the Commissioners not to automatically renew his contract was made in bad faith, undermining and interfering with the applicant’s constitutional right to work in the Co-operative Republic of Guyana.
Among other things, the Chief Justice had previously granted an Order preventing the Commissioners from making a decision not to renew the contract of Gocool Boodhoo for the position of Chief Elections Officer, without following the procedure which has been established by the Guyana Elections Commissions as it relates to the renewal of contracts for service employees.
At the hearing yesterday, the Nisi Order granted was discharged by the Chief Justice.
