MURDER accused Robert Abrahim, who was indicted in the Soesdyke/Linden Highway murder case, has been acquitted.
He was freed, by Justice Dawn Gregory, on a no-case submission by Defence Counsel Huckumchand last Thursday.
That followed the close of the prosecution by State Counsel Renita Singh and Diana Kaulesar.
The judge agreed with Huckumchand that the prosecution had failed to prove, conclusively, that the accused was the person who caused the death of the victim.
The State had set out to prove that, on January 10, 2008, Ganesh Singh was drinking with another person at a Long Creek farm along Soesdyke/Linden Highway when Abrahim was offered a drink but he refused.
However, the latter, subsequently, decided to have a few drinks with the two men and, during the drinking spree, Ganesh Singh picked up a 22-inch cutlass and lashed the accused on his head and hand.
As a consequence, the accused rushed to a room, armed himself with another cutlass and stabbed Singh in the face, causing him to die later from an injury which the doctor, at a post-mortem, described as hypovolemic shock.
Huckumchand argued that the prosecution did not lead evidence to establish that the injury which resulted in death was caused by the accused.
The judge, agreeing, directed the jury to return a formal verdict of not guilty in favour of the accused.
