Schoolboy, elder brother freed of drug charges
TWO brothers had two drug charges against them dismissed on Wednesday, for want of prosecution. It happened at Vreed-en-Hoop Court after defence counsel Mohamed Zafar argued that the ‘not in possession of file’ submission is unacceptable and, if maintained, would cause the judicial system to suffer.
He said Prem Lackhan, 22 and his 13-year-old sibling had made punctual Court appearances, despite the latter being a schoolboy.
It was alleged that, on June 3, 2010, at Anna Catherina, also on West Coast Demerara, they were in possession of two grammes cocaine and three grammes cannabis (marijuana) for the purpose of trafficking.
Bail had been granted, under special circumstances, by Magistrate Nyasha Williams-Hatmin, in the sum of $50,000 for the teen and $100,000 for his older brother, after both pleaded not guilty.
However, Magistrate Sherdel Isaacs-Marcus threw out the cases because no witnesses appeared nor were any exhibits tendered. (Juliet Bachu)
