MARLON Watson of Berbice who was convicted for being in possession of narcotics for the purpose of trafficking and was sentenced to three years imprisonment with a fine of $10, 000, yesterday successfully appealed against his conviction and sentence.
However, Watson who was found guilty of the crime by Magistrate Krishendat Persaud, will have to face a new trial.
The Full Court constituted by Acting Chief Justice Mr. Ian Chang, S.C which heard the appeal, allowed the appeal but ordered a new trial in the interest of justice.
At the trial and the appeal, the accused was represented by Attorney-at-law, Mr. Mursalene Bacchus.
The evidence led by the prosecution disclosed that the defendant was found with 12 kilogrammes of cannabis in his possession at Matthew Allen Road, New Amsterdam on October 20, 2007. Sentence was imposed in 2008.
The main ground of appeal was that there was no evidence to sustain the finding that the appellant was in possession of the drug on the day in question. The appeal was allowed and a re-trial ordered. (GEORGE BARCLAY)
