JUSTICE Rishi Persaud, last Friday, in response to the writ and injunctive orders granted on the application by Claude Adams, ordered that Case Development Company Ltd, Two Brothers Corporation and Guyana Geology & Mines Commission (GGMC) appear in Court on October 6.
The applicant Adams had said he is a miner who has been engaged in the business for the past 36 years, carrying on gold and diamond mining operations at various locations in the interior.
He said Case Development is the holder of a medium scale mining permit in respect of a tract of State land situated in Mining District Number Five, on the right bank of Barama River in North West District, as shown on Terra Surveys Topo Sheet with boundaries fully set out in the schedule attached.
Adams said the permit was issued to that first named defendant by GGMC in 2004 and, prior to the grant, Case Development was in occupation of the same place under a medium scale prospecting permit since or about the year 1995.
Adams said, during 1999, he entered into an oral agreement with Case Development, through its principal and Chief Executive Officer, Hamley Case, that the former will work on the location using one six-inch land dredge with an option to add other dredges without paying any fees, rent, charges, commission or tribute.
But Adams said he has been informed by his counsel, Mr. Anil Nandlall that to eject him or interfere with his operations there is not only unlawful and would amount to a breach of contract but is also unfair, unjust and inequitable.
Adams said he fears that unless he receives the protection of the Court, the defendants will jointly or severally remove him from the land.
Consequently, the judge restrained the defendants, by themselves, their servants and or agents or any of them, from dispossessing or evicting or in any manner whatsoever interfering with the plaintiff’s quiet and peaceful enjoyment, occupation and possession of the land and from entering, remaining or occupying it.
