Nisi Order dismissed in Canal No. 1 watch house case

JUSTICE Roxanne George on Friday discharged a nisi order which had given applicant, Deodat Deokinandan a writ of prohibition restraining the Boerasirie tribunal from dismantling the applicant’s building, which turned out to be a resort instead of a watch house. As a consequence, the applicant, a farmer and building contractor and the owner of a cattle ranch, who is also the holder of State Forest Permission was waiting with great expectation to hear that his nisi order was made absolute when he learnt that a plan was afoot to have his watch house dismantled by the Boeraserie Commissioners.
Deokinandan said that he had made an application to the Canals Polder NDC Canal No. 2 Polder. West Bank Demerara to occupy a piece of land which is situated on the southern reserve at the Canal No. 1 road end. He intended to fence a piece of land and to construct a small wooden building which will be used as a ‘Watch House’.
Later the applicant was written to by the Boeraserie Commissioners informing him that the site is part of the Conservancy’s reserve and no permission was sought nor given for such a project by the Boeraserie Commissioners.
The applicant was told that the Commissioner views this matter with great concern and as a result now “gives you notice to dismantle the structure within 14 days, failing which the Commission will have no alternative but to take the necessary step to dismantle same.
The applicant was represented by Mr.  Mohabir A.Nandlall, Attorney-at-Law.
When the matter came up for hearing on Friday Justice George referred to the facts of the case after which she discharged the nisi order.
With the Order Nisi out of the way it is now up to the Boerasirie Commissioners to dismantle the building.
Deputy Solicitor General Mr. Nareshwar Harnanan appeared for the respondent and the Attorney General was awarded $50, 000 as costs.
