WITH reference to various letters to the press and a recent one by Mr. Leon Jameson Suseran, enquiring whether “Anyone was ever successful in prosecuting noise nuisance ?.”
Please be advised that after careful consideration and investigations I found that Senior Counsel Rex Mckay took action against the Georgetown Cricket Club and was successful.
It is always better when a number of persons in any area work together and share the legal costs. I think very soon there will be others who are successful.
My understanding is that the judges are very considerate , with noise nuisance, which is why I am troubled, that magistrates give permission for the most vulgar and lawless of shows, going into the wee hours of the morning in quality residential areas, knowing fully well that noise is destructive to people and their lives. Magistrates are supposed to be judges in waiting. They should have the mature and wise persona that elicits respect and decorum. Some say that magistrates were lawyers, and lawyers are known to like to collect fees, while I do not share this view, it is interesting to listen and think.
It is also right , that the Honourable Chancellor of the Judiciary gets involved and charts a guidance policy for magistrates, especially the new young ones on stream on the noise issue which is causing so much misery to people lives, students, the ill and the hardworking.
