BY verbal agreement plaintiff Faye Kennedy, had agreed with Abiola Griffith Vancliff to build a structure on Faye’s Sophia property, which she (Abiola) could use until she decided to migrate. But after the structure was completed, Abiola migrated leaving the umber one defendant, Jermin Bailey, in charge of it.
The number one defendant got the number two defendant, Faye Savory, to live with him in the same structure.
Later Griffith relinquished all her rights and interests in the structure to one Candace Jonas.
This resulted in the plaintiff claiming from the defendants the property at Lot 129, Block E, South Sophia, Georgetown.
The story began on or about the year 2003 , when by verbal agreement the plaintiff agreed with Abiola Griffith who was at the time having a relationship with her son, the number one defendant, that she would build a structure and live on her property at Lot 129, Block E. South Sophia, Georgetown until she migrates to the U.S.A.
In the year 2004 after building the structure, Abiola Griffith Vancliff migrated leaving Jermin Bailey in occupancy of the property situated at Lot 129 Block E. Sophia, Georgetown, Guyana.
That on or about the year 2006, the number one defendant Jermin Bailey caused the number two defendant, Faye Savory, to occupy the said structure with him on the property without the plaintiff’s consent.
The two defendants continue to occupy the property.
The plaintiff made several demands to have them removed from her property but they failed or refused to remove.
That by undated letter, the Plaintiff gave the defendants notice to remove and deliver up possession of the property on or before the 31st day of July 2012, but the defendants have failed and or refused to remove.
That by notarised letter dated 3rd June, 2012 Abiola Griffith Vancliff has relinquished all her rights and interest in the structure she was permitted to build on the Plaintiff’s property to Candace Jonas.
Whereupon the Plaintiff’s claim against the defendants is for the possession of her property situated at Lot 129 Sophia, Grorgetown, Guyana.
When the matter comes before the court for hearing, the plaintiff will be represented by Attorney-at-Law, Mr. Gordon Gilhuys.
