TYRONNE Mortley, of Bee Hive Public Road, who allegedly raped a 14-year-old girl in April and in October, 2006, will know his fate today.
Prosecutors Mrs. Teshana James-Lake and Mrs. Judith Gildharie-Mursalin yesterday urged the jury to believe that the accused betrayed the good relationship he enjoyed with the father of the girl to rape her on two occasions. The accused, according to the prosecution, had made a confession statement to the police in which he stated that he had sexual intercourse with the girl. Although the judge found that the confession was obtained freely and voluntarily, the accused, in court, is denying that he ever had sex with the girl.
Defence counsel Mr. Compton Richardson noted that a medical report on the girl, which the doctor was not called to verify, had shown that the girl who alleged that she was raped by the accused in October was examined in December and found to be nine weeks pregnant and also had an incomplete abortion.
The lawyer asked the jury to believe that if the doctor had been called to clarify the report, he would have been able to say if the allegation about rape in October could have been the cause of the pregnancy in December.
That he said made it clear that the jury must find that there was a reasonable doubt that the accused could have committed the alleged crime.
