REACTING to an ex-parte application from the Director of Public Prosecutions (DPP) on Friday, complaining that the orders granted by Justice Roxanne George for the DPP to observe certain instructions related to the listing of prisoners for trial, Chief Justice Ian Chang, S.C., has granted the DPP an interim order.
The Chief Justice, among other things, directed that the orders from Justice George should be treated as directory until the hearing and determination of the notice of motion before the court.
The Chief Justice, upon hearing Attorney-at-law for the DPP, ordered that the orders made by Justice at Gaol Delivery on the 27th, 28th and 31st May, 2010, at the April, 2010 Criminal Sessions for the Demerara Assizes, be treated as directory until the hearing and determination of the notice of motion filed.
In her notice of motion, issued by lawyers headed by Mohabir Nandlall, the DPP is asking for a declaration that the orders of the judge are unlawful, irregular, in breach of and contrary to Section 14 (8) and 187 of the Constitution, in breach of and contrary to Section 14 of the Criminal law (Procedure) Act, Chapter 10: 01, in excess of and without jurisdiction, contrary to and in breach of the rules of natural justice, null, void and of no effect.
The DPP is also asking that a conservatory order be granted, staying and or suspending the executions and the orders made by the judge until the hearing and determination of this notice of motion.
