The Guyana Court of Appeal on Thursday unanimously dismissed an appeal challenging the legality of the Recount Order which preceded the recount of the votes cast at the March 2 general and regional elections.

This came to effect in the Missinger Joned vs GECOM et all matter.

The court on Friday also ruled that any challenge to the recount or the setting aside of the Declarations of the administrative regions must come by way of an elections petition.

The court also ruled that Chief Elections Officer Keith Lowenfield is subject to the directions of the Guyana Elections Commission (GECOM)

Chief Justice (ag) Roxane George-Wiltshire two Mondays ago ruled that the results of the 2020 General and Regional Elections could only be based on the data coming out of the National Recount, noting that at this stage, the 10 Declarations made in March cannot be resurrected.
She also ruled that Chief Elections Officer Keith Lowenfield must comply with the rules of the Elecitons Commission.

A 24 hour stay of the ruling on Thursday has been granted.
