– police yet to decide what to charge him with

THE man who was recently heard lustily singing, ‘Let the blow-blow blow’, whilst driving and showing off a cache of high-powered weapons and other small arms and ammunition has been released from police custody.

Jermaine Kingston, of Jumbo Jet Auto Sales, was ordered released from police custody by Justice Simone Morris-Ramlall on Sunday, and the order securing his release served on Police Commissioner Leslie James.

Kingston was set free after his lawyer approached the court to argue that he was being held past the mandatory 72 hours without being charged, or the police seeking and being granted an extension to keep him in their custody, and in the police lockups to boot.
Kingston was arrested since June 17, and up to Sunday, the police had not yet decided what they were going to charge him with, or what offence he’d committed.

The Guyana Chronicle was told that while the offence was clearly a matter of inciting public terror, the police was seeking to have Kingston charged with treason.

In the video, which went viral on social media, Kingston called for the removal of the APNU+AFC government, and threatened violence if they do not vacate office peacefully.
In her ruling, the judge ordered the commissioner to release Kingston forthwith, and to pay the court cost of $150,000.

The Order of the court also expressly stated that should the Commissioner of Police fail to comply with it, he could face jail time or have his assets frozen.

The document in question reads: “The court orders, by consent, that the Commissioner of Police forthwith release from custody the applicant, Jermaine Kingston. This court further orders that the respondent pay costs to the applicant in the sum of $150,000. If you fail to comply with these terms of this order, you will be held in contempt of court, and may be liable to imprisonment, or to have your assets confiscated.”

The ‘Top Cop’ and several other individuals were served with the court order on Sunday, following Justice Morris-Ramlall’s ruling, via a Zoom Cloud Hearing, after a Habeas Corpus was filed on Kingston’s behalf by one Joshua Marcus, through Attorney-at- Law Everton Lammy.

At the hearing on Sunday, the police did not produce Kingston, which resulted in the judge granting the orders to have him released immediately. (Leroy Smith)
