CHIEF Magistrate Ann McLennan yesterday discharged the case against Ewart James who was charged with attempting to commit murder.The charge stated that on Friday, November 27, 2015 at Sarah Johanna, Ewart James wounded Sherwin Hamilton with attempt to commit murder.
It was alleged that James dragged Hamilton several feet and threw acid on the ex-police constable. He managed to escape and his girlfriend took him to the hospital.
However, the magistrate stated in her submission, that the virtual complainant’s evidence in relation to the accident was inconsistent and vague and the prosecution had failed to provide the court with evidence that it was attempted murder.
The Magistrate said that abrasions could not cause murder, only wounding.
