IANA Noble, who was an alleged victim of an assault to commit murder at Wismar by accused Jennifer Warden in 2010, on Friday refused to testify against Warden.As a consequence, there was no evidence given against Warden and she was freed.
The incident took place at the Demerara Assizes before Justice Priya Sewnarine-Beharry midway through the trial Friday morning, when the complainant informed the court that she no longer wanted to testify against the accused
The complainant told the prosecution that her action was not the result of anyone forcing her to do or say anything and that what was done was her work and no one else.
After hearing this, the prosecution decided not to offer further evidence in the matter.
Justice Sewnarine then told the jury that as a result of what had transpired, the Law provided that she, the judge, must direct the jury to return a verdict of not guilty in favour of the accused.
Later, the jury returned a verdict of not guilty in favour of the accused Jennifer Warden.
State counsel Michael Sharoud and Orenthia Schmidt conducted the case for the prosecution. Linden Amsterdam represented the accused.
