Confession statement challenged

WHEN the Anthony Morrison trial for the murder of Donna Thomas in 2012 continued at the Demerara Assizes yesterday, defence counsel Mr. Harun Gajraj suggested to prosecution witness that the alleged oral statement (confession) was a fabrication by the police.The witness denied the allegation.
This oral confession came about after witness Odel Percival told Prosecutrix Miss Stacy Goodings that he was present at the Brickdam C.I. D. on May, 31, 2012 when Constable Kyte contacted suspect Anthony Morrison who was in custody. According to Percival, policeman Kyte told Morrison that it was alleged that he (Morrison) between May 25 and 26, 2012 murdered Donna Thomas. Const. Kyte cautioned the accused who replied: “I was going out and she did not want me to leave. She held on to me. I had a knife and I cut she upon she right hand and left. I did not know that would happen to she.”
Percival, continuing his testimony, said as a result Constable Kyte asked the accused if he wished to give a written statement under caution and the accused replied “No.”
Percival added, “At no time did I or anyone else, use any force, threat, promise or inducement to obtain that oral confession.”
In a statement, Constable Jason Kyte admitted under cross-examination that he did not search for the station diary as he promised the court to do.
Under cross-examination he denied a defence suggestion that the oral confession was never made by the accused and was a fabrication by the police who had nothing else to link the accused with the murder.
Prosecutrix Miss Stacy Goodings had told the jury in her opening address that evidence would be led to show that the accused inflicted injury on Donna Thomas and that she died as a result of that injury.
The prosecution is hoping to lead both direct and circumstantial evidence in support of its case, the prosecutrix said.
The hearing continues today before Justice Sewnarine Beharry and a mixed jury.
