Rohee Parliament issue… Granger moves to strike out Nandlall motion

OPPOSITION Leader David Granger moved to the High Court on Tuesday, seeking to have Acting Chief Justice Ian Chang order that the originating notice of motion, by Attorney General (AG) Anil Nandlall, denouncing the action against Home Affairs Minister Clement Rohee deemed unlawful and struck out.

The summons issued by attorney-at-law, Basil Williams in association with a battery of lawyers headed by Senior Counsel Rex Mc Kay is also

* an order staying all proceedings at the instance of the applicant,  until the hearing and determination of this summons and
* such further or other orders as the Court may seem just.
Copies of the summons have been sent to the applicant, the AG and the Speaker of the National Assembly, Raphael Trotman.
In his affidavit, Granger said, in part, that he had read what purports to be an originating notice of motion and affidavit in support of it, dated and sworn, respectively and filed on November 27 on behalf of the applicant.
Granger noted that the applicant is seeking declarations that the ruling committing the motion to the Privileges Committee and prohibiting Rohee from speaking or not being recognised for the purpose of presenting any bills, motions or making other representations to the House,              are unlawful, unconstitutional, ultra vires, in excess of and without jurisdiction, contrary to the rules of natural justice arbitrary, capricious, null and void and of no effect.
Another declaration sought is that the Privileges Committee has no jurisdiction to deal with or determine any issue remitted to it by virtue of the aforesaid ruling of the Speaker made at the Third Sitting of the First Session of the Tenth Parliament on November 22.
But respondent Granger said he believes that the applicant’s motion does not disclose any cause of action.
