MURDER accused Vincent Vandenburgh, who was charged with possession 14 grammes of cannabis sativa (marijuana) in New Amsterdam Prison, has been freed of the charge.
Magistrate Adela Nagamootoo ruled, at New Amsterdam Court last week that a no case had been made out against him.
Vandenburgh who is facing trial for allegedly killing Lord Edwards called Junior at Edinburgh Village last April 5, was alleged to have had leaves, seeds and stems of the prohibited plant.
During the trial, Chief Prison Officer Oldfield Romolus had testified that, on July 15 last, around 02:30 hrs, he was among officers conducting a search in cell number 23 which was occupied by the defendant and two other prisoners.
The witness said, while the inmates were lying on mattresses on the ground, Vandenburgh was asleep in a hammock.
Romolus recalled that the accompaning ranks, Hemmerding, Darlington and Diaz entered the cell whilst he stood by the door as the occupants of the room were searched.
Romolus said Vandenburgh was awakened and submitted himself to be searched but, as he exited the hammock, one of the accompanying officers picked up a blue and white rag, which, when opened, contained a plastic bag in which were leaves, seeds and stems, suspected to be portions of the hemp plant.
However, when questioned as to how he came in possession of the narcotic, Vandenburgh opted to remain silent, the witness recounted.
Romolus said, after the parcel, which was subsequently secured, had been handed to him by Darlington, the search continued within the cell. The following day, Police Detective Braithwaithe on arrival at the prison was given a kerchief, the contents of which weighed 14 grammes.
In response to Defence Counsel Mursulene Bacchus, the witness recalled searching other cells, including number 23 and said number 22 which had three occupants was also subject to a search.
Romolus said, while there are no beds within the cells, mattresses were there for prisoners to sleep on the floor.
He admitted that he did not mark the handkerchief before securing it in the ‘strong box’ and agreed that there are thousands of similar handkerchiefs.
