Canada & US-based Guyanese in court battle with local relative over land

PLAINTIFFS Vickram and Tara Ramcharran, now residing in Canada and the USA respectively, are locked in a legal battle with a relative in Guyana over a portion of land known as Parcel 164, Lot 149, Industry Housing Scheme, East Coast Demerara. Their duly constituted Power of Attorney, Ganga Satnarine of Guyana, has approached the Court in Guyana for possession of the land, and alleges that the plaintiffs had granted oral permission for the defendant to occupy same temporarily sometime in 2004.
And the Power of Attorney is now saying that the plaintiffs have decided to revoke this permission, but have met with non-cooperation by the defendant, who elected to remain on the property at Parcel 164, Lot 149 Industry Housing Scheme.
A statement of claim has been filed, which included injunctions and claims for damages.
It has been pointed out that the plaintiffs and the defendant are related, and that the plaintiffs are the lawful owners of the property situated at Parcel 164, Lot 149 Industry Housing Scheme, E.C.D., Guyana, and more fully described on Certificate of Title to Land No. 93/1533, copy of Certificate of Title hereto exhibited and marked “B”.
It has been stated that the plaintiffs, being the owners of the said property, granted oral permission to the defendant, sometime in 2004, for the defendant to temporarily occupy the upper flat of the property/dwelling house situated at Parcel 164, Lot 149 Industry, East Coast Demerara, Guyana.
It is said that the plaintifs revoked the said permission sometime in 2011, and made several oral requests thereafter for the defendant to quit and deliver up possession of the said property; but the defendant remains in occupation, refusing and/or neglecting to give up same.
That the plaintiffs further caused to be served on the defendant a Notice to Quit dated the 12th July, 2012 to deliver up possession of the said property/dwelling house on or before the 26th day of July, 2012, but the defendant again refused to comply with the plaintiffs’ request.

Wherefore, the plaintiffs claim from the defendant:-
(a) Possession of property situate at Parcel 164, Lot 149, Industry Housing Scheme, E.C.D.
(b) Damages in excess of $50,000 for trespass.
(c) An injunction restraining the defendant by herself, her servants and/or agents howsoever from entering, remaining on and/or occupying the said land.
(d) A Mandatory Injunction compelling the defendant herself, her servants and/or agents to remove from the said property.
