Assault complainants penalised for wasting court’s time, stationery
TWO policemen appeared in court yesterday, charged with assaulting the owner of White Castle Fish Shop and two of his employees. Sergeant Leon Lindo and Corporal Dave Persaud (no addresses given) pleaded not guilty before Acting Chief Magistrate Priya Sewnarine-Beharry.
The charges against Lindo stated that, last August 5, he unlawfully assaulted Jermaine Langevine and Pearl Haynes, the former to cause him actual bodily harm.
The charge against Persaud said, the same day, he unlawfully assaulted Delon Williams to cause him actual bodily harm.
Police Sergeant Lionel Harvey, prosecuting, said the defendants, who were on duty, went to the Hadfield and John Streets, Stabroek, Georgetown fish shop, in response to a noise nuisance report and an argument arose with the virtual complainants.
Lindo was put on $100,000 bail and Persaud was ordered to post $50,000 surety.
However, when the case was called later in the day, for report before Magistrate Judy Latchman, the virtual complainants said they did not wish to offer evidence against the two cops.
The charges were dismissed and the virtual complainants were compelled to each pay $50,000 court costs or spend seven days in jail, for wasting the court’s stationery and time.
