Ruling on murder indictment expected today
JUSTICE Dawn Gregory-Barnes is expected to rule, at the Berbice Assizes today, on preliminary submissions made by defence counsel Rabindranauth Singh, seeking to quash the murder indictment against Khemraj Charrandeo and Gopaul Kulsey.
The two accused are indicted for the unlawful killing of Ken Leitch between March 10 and 12, 2008 at Ankerville, Port Mourant, Corentyne.
Singh advanced his legal arguments before state prosecutor Rondel Weaver opened the case for the prosecution, in the absence of the jury.
Defence counsel argued that the committal ought to be quashed on the ground that the magistrate, in the lower Court, failed to comply with the mandatory provision of Sections 65 and 71 of the Criminal Law Procedure Act. (Jeune Bailey)
