Hearing of President libel action against Kissoon/Kaieteur News begins August 19

JUSTICE Brassington Reynolds will begin hearing the libel action brought against Freddy Kissoon and Kaieteur News by President Jagdeo, on August 19, 2011.
When the matter was called up for fixture yesterday, Attorney-at-Law Mr. Anil Nandlall, for the President, indicated to the Court that there was no entry of appearance or authority to Attorney-at-law on the record, in relation to Mr. Nigel Hughes.

The judge ordered that Mr. Hughes put himself in order.
The judge further fixed a number of dates for the trial to commence and continue.
The judge indicated to the lawyers that when the trial commences, he hopes it will be confined to the issues raised in the case and will not be a platform to ventilate extraneous matters.
Other lawyers representing the defendants are Mr. Khemraj Ramjattan, Mr. Neil Persram and Mr. Christopher Ram.
Earlier, the defendants had appealed against an order of Chief Justice Ian Chang granting an  interlocutory injunction restraining them from  repeating the alleged libel  until the hearing and determination of the summons.
But the Full Court of two judges, who heard the appeal, dismissed the application and affirmed the ruling of the Chief Justice.
The defendants Freddy Kissoon, Adam Harris, and National Media and Publishing Company of Kaieteur News were sued for publishing an article containing words of/ or concerning the Respondent/Plaintiff in the Kaieteur Newspapers on July 28, 2010 under the Caption, “King Kong sent his goons to disrupt the conference”.
In their appeal, the defendants were saying that since they pleaded justification, privilege and fair comment, there was no need for the injunction to continue.
But during the hearing of the appeal, Mr. Nandlall submitted that the constitutional right to free speech  is subject to the law of defamation and is not a licence  to libel and slander.
